RE: Employee Misconduct and the Americans With Disabilities Act

Recently, Rick Finberg co-authored an article analyzing disability triggered employee misconduct and to what extent an employer must tolerate such misconduct.  The article arose from a case we won which is currently pending before the United States Court of Appeals.  The Defense Research Institute, a national legal association for defense and corporate counsel, published the article in For The Defense magazine.  Rick is active in the DRI’s Employment Law Section.
