RE: Union Organizing Efforts

Our firm has assisted scores of employers avoid unionization. In the business environment we find ourselves today, unionization is bad not only for the employer but for the employee as well. Unions reduce an employer’s flexibility to respond quickly to business needs. Contrary to the typical union message, unionization also has a negative impact on an employee’s job security.

Because unions are struggling and cannot support their professional organizers’ salaries without increasing membership, unions are developing new and more aggressive organizing strategies. Unions are also investing unprecedented amounts of their resources in to these campaigns. To counter the unions’ renewed efforts at organizing, we have also developed creative responses to their tactics.

In that regard, we are pleased to report that The Bennett Law Firm has continued our extremely positive track record of keeping employers union free. The Teamsters recently conducted an aggressive effort to organize Lepage Bakeries’ Hudson, New Hampshire Distribution Center. After a two month campaign, the Lepage Bakeries associates rejected the Teamsters by a more than 8 to 1 margin. This was a significant victory for both the Company and the associates and a significant loss for the Teamsters.

Although we are proud of our track record in defeating unions at the ballot box, we also encourage our clients to be vigilant in monitoring employee morale and possible organizing activity. Our Firm has developed a number of tools to work with management to stop the union before it conducts extensive organizing activity. Some of these tools include employee relations and union vulnerability audits and union avoidance training for managers and supervisors. We encourage you to take advantage of these specialized services. Such services can save your company tens of thousands of dollars and help you maximize your ability to maintain a flexible, cooperative and productive workforce. And, when you engage the services of The Bennett Law Firm, you can also have the comfort that if a unionization effort does go to a vote, we can provide you with a union avoidance program that is not matched in the Northeast.

For further questions on union avoidance training or any other labor relations and employment law issues, please contact Peter Bennett or me.

Sincerely,

Frederick B. Finberg
